Terms of Use & Job Posting Agreement

This document states the terms of our agreement together.

       Contact Information: This information is to be used to create your account. We will use this information to contact you.  Please be careful to specify a correct phone number and e-mail address.

       Introduction: This agreement is made between NukeWorker.com and you, the Job Poster, who agrees to purchase a “Job Posting Package” on the NukeWorker.com site on the World Wide Web, operated by NukeWorker.com

       Terms and Definitions

·         The Job Poster is the party named in the Job Poster Contact Information listed on the site, and is placing and paying for the Job Posting Package described in the agreement.

·         NukeWorker.com is a not-for-profit corporation located at 7809 Blueberry Road; Powell, TN  37849-3406  USA

·         NukeWorker.com is an Internet publication owned and operated by NukeWorker.com and found on the World Wide Web at http://www.NukeWorker.com

·         Job Posting Package is the ability to post jobs in the NukeWorker.com job board for the duration set forth in the specific job posting package chosen, typically one year.  

·         Job Posting Package Impression means a single (1) display or impression of the Job Poster's job posting viewed from NukeWorker.com.   The amount of impressions or ‘views’ is available by viewing the statistics in your profile.

·         Start Date is the date on which payment has been made and the funds have cleared the bank.

       Duration of Agreement: Job Poster’s Job Posting Package will appear on the NukeWorker.com Web site for a set duration, defined in the specific job posting package chosen, commencing on   the date payment is received. All Job posting agreements MUST be paid in full prior to the Start Date. This fee is non-refundable, and will not be prorated should the Job Poster decide to discontinue the display of the Job Posting Package at any time prior to the end of the contract period.

       Display, Placement and Links: Each Job Posting will be placed by the Job Poster and remain there until the Job Poster removes the Job Posting, or four months have elapsed. If the Job Poster requests that the Webmaster or site administrators remove the Job Posting for the Job Poster, there shall be a $25 administration fee charged the Job Poster.  Additionally, if a Job Posting is placed in an incorrect category, the incorrect posting may be deleted by the webmaster or site administrators. Job Title summary's must be short, and can not contain all capital letters.  Job titles containing all capital letters will be edited by the webmaster or site administrators, and a $25 administration fee will be charged to the Job Poster.

       This agreement is non-exclusive, meaning NukeWorker.com may have Job Posting Agreements from several parties appearing on its site at the same time. The NukeWorker.com software manages the order of placement of Job Postings by order of date of postings when searched.  

       The NukeWorker.com software also allows the Job Poster to maintain a profile that includes a logo image and a text space for a company tagline or description, contact information, email link, and website link.  If the Job Poster needs help customizing this section there will be a charge of $200.00 to create a logo for you.

       Status reports: NukeWorker.com software provides the Job Poster with a tally of job posting views that displays how many times the Job Posting has been viewed, and how many online application have been filed.  NukeWorker.com does not and cannot make any representation or warranty as to the number, frequency or duration of any such job posting response.

       Services interruptions: Job Poster agrees not to hold NukeWorker.com responsible for any liability, loss, cost, claim, damage or causes of action of any kind that it may suffer as a result of the transactions contemplated hereby, including but not limited to loss resulting from service delays and incomplete or interrupted service, regardless of cause or fault.    

     

       Truth in Job posting / indemnification for liability: The Job Poster is solely responsible for any liability arising out of or relating to the Job Posting, and/or any material to which users can link through the Job Posting. The Job Poster represents and warrants that any information found in any message or on URLs hyperlinked from the Job Posting will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, image, or other proprietary or confidential information or property right, false Job Posting, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any antidiscrimination law or regulation, or any other right of any person or entity.        Job Poster agrees to indemnify NukeWorker.com and to hold NukeWorker.com and its officers, directors, employees and agents harmless from any and all liability, loss, cost, damage, claims, or causes of action of any kind, including reasonable legal fees and expenses that may be incurred by NukeWorker.com, arising out of or related to Job Poster's breach of any of the foregoing representations and warranties

       Governing law: This Agreement and the resolution of any dispute related to this Agreement shall be governed by the laws of the State of Tennessee without giving effect to any principles of conflicts of law. Failure by NukeWorker.com or its affiliates to insist upon strict enforcement of any provision of this Agreement shall not be construed as a waiver of any provision or right

       Fees and Initial Payment: All fees are payable in advance of the commencement of display of the Job Postings on the NukeWorker.com web site. All Job Posting fees are non-refundable.

       All payments must be in U.S. funds. Credit card orders are instantly approved.  Checks must clear before your account will be approved, and should be made out to “NukeWorker.com” and sent to the following address:

       Upon execution of this Agreement, NukeWorker.com will commence setup for Job Poster’s Job Posting Package. NukeWorker.com will make the account visible to the Web upon receipt of payment.

       Sole Agreement: This document constitutes the sole agreement between NukeWorker.com and the Job Poster regarding this Web site. Any additional work not specified in this contract must be authorized by a written change order. All prices specified in this contract will be honored for 30 daysafter both parties sign this contract. This Agreement may only be modified, or rights under it waived by a written document executed by both.

Violation of any of the terms and conditions of this contract may result in the immediate termination of your services with NukeWorker.com, at our discretion.

You agree to the above-listed contract in its entirety.
