Warning violation
« on: Jul 31, 2012, 03:38 »
I was recently in a discussion regarding the notification of workers on site about inspectors who were making their rounds.  I could not recall the penalty for doing so, but do remember that there was to be no announcing of inspectors making their rounds, inspections, travel paths, etc.  Does anyone know if there is a penalty for making such announcements?

I remember working at a boiler in New England and Security announced over the PA that the NRC had just arrived on-site for an unannounced inspection.  Not sure what happened to the guard.  This was a long time ago.

On my boat in the Navy a double click on the 2MC (PA system) told us the Balrog was headed to the engineering spaces. A couple of power plants had specific pages for fictitious people that keyed workers in on craft supervision or inspectors. These were tribal knowledge in the rank and file not licensee actions, hard to control by management.

Yeah but,...

The OP was not asking for ideas or sea stories on how to impede an inspector,...

He was inquiring as to the penalties for doing so,...

To my knowledge, there is no set schedule of penalties where Infraction A costs Penalty B,...

But then, I've never been on the wrong side of the table with a compliance officer,...

Penalties are addressed in Section 234 of the AEA,...

The logic for assessing the severity is addressed here;

http://www.nrc.gov/about-nrc/regulatory/enforcement/guidance.html#manual

That should get you started (some more),... 8)

Back on topic, I have not found any penalties for compromising an unannounced inspection but there is guidance in the NRC inspection procedures on how to keep a surprise inspection a surprise even recomending changing patterns of travel and hotels.

I couldn't find anything specific on it either. However, I do remember a contract worker warning people in the drywell that the resident inspector was on his way in.
He was gone within a few hours, never to be heard from again. :->

The craft there had a warning signal as well (code phrase). It was used for anyone; NRC, Safety, Supervision, Management...

There is no regulatory penalty for what you asked.  The only penalty would be if your company/utility has some policy against it.

BTW I assume you mean NRC inspectors and not FDA  ;)

hope that helps

Actually, if they wanted to persue it and could prove it you could get a Traditional Enforcement Security Level IV Violation for Impeding the Regulator
