Bui boating under influence?

ive held a nuke badge for about 5 yrs and decied to travel outages i was layed off may 2012 and turned in my badge while i was layed off not badged i was arrested for a bui by a fwc officer 8 hrs later i was back home thinking how this is going to affect my job wasnt being stupid or anything just idling to the ramp got a random safety check anyways its a misdemeanor on a boat my first and only run in with the law no criminal record hired a lawyer may be dropped or charged as reckless boating still pending right now but i have a hire date for an outage in nebraska in oct 2012 how is this going to affect my clearance im so confused and worried about this because i havent heard of this type of charge before and dont know what the outcome will be memorial day weekend off was out of town since jan come home for a weekend to relax and enjoy now im worried if ill be able to get another badge thanks for any input

Seems like nearly every one of these stories has a charges "will be expunged" or "gonna be dropped" line in it.

As long as the charges are outstanding, it's gonna show up on your background check. PM Graphic for how that goes....

The first effort you put into this whole topic was that post. A little better, but please keep the demands to yourself. You are among professionals and if you have to act like it for the first time in your life, just do it and don't whine about it. I guarantee if you go into life demanding help and crying when if comes with a bit of good advice you will fail. Apparently that means more to us than it does to you.

another on-topic point: Even if the charges are reduced, if there is a conviction and alcohol is involved, there is a real good chance that the FFD folks are going to want to see a completed rehab course prior to badging.

Any time you have a run in with the law, you musy hire an attorney. Even if for only a speeding ticket. In the case of a speeding ticket, if you have a clean license the charge will be dropped or reduced to something that simple that has no affect on you record. Once you plead guilty to a speeding ticket a couple things happen. One, the next cop knows you're a speeder so he's less likely to let you off with a warning, Two the next DA knows you're a speeder so he's less likely to drop the charges...
In the case of your BUI, your lawyer should have no problem getting the charges dropped or reduced as long as you have a clean record. So as long as you keep a clean record you'll be much better off. That means lawyer up for everything. So instead of coming to this board, go tell you lawyer what happened and what the possible consequences are of a conviction. Even if the DA's office doesn't want to drp the charges, they also don't want to put you out of a job...but they will if they think you are a trouble maker, and the only way they know that is if you have record of not hiring a lawyer when you should. Keep in mind almost every assistant DA intends to go to work for one of thsoe guys you'll be hiring to get you out of trouble.
Good luck...and by the way, typing skills, and good grammar and punctuation, are two very different things. Take the time do it right just like your next boss expects you to when performing your next job whatever that may be.

You will want to make sure every part of the conviction/sentence is cleared up before your work start date.  I don't believe they will clear you if you are on probation.  +1 on a completed rehab program also.

Experience based:

They can clear you if you're on probation.  No matter the legal outcome, it still shows as an alcohol related arrest and will be treated as such.  Your company/nuke will probably require a report and training plan from a certified addiction counselor, with successful completion.  You will pay for this, but you could have your lawyer use this as a reason to grant leniency- that you're going to get help, regardless if the case is dropped or reduced.  You will probably be on the escalated FFD program- drug tests at least biweekly for a year.  They will require all court and probation documentation.

This all assumes they're willing to put forth the effort...

As for the other's posts about your lack of punctuation and the inability to use grammar to make complete sentences, when you come here, you agree, by posting, to be judged by us, your peers.  There is a wealth of knowledge and years of superb experience here, but if you come across as unprofessional, which is what you initial post screams about you, that is the first impression people get about you.  Whether it is a true reflection of you, the actual person, or not, it is all we have to go by.  Also, you have to be willing to take the lumps when you do something dumb, and anything involving alcohol and boating/driving/operating equipment is just that, dumb.

If you are truly concerned with your ability to maintain the privilege to have unescorted access to a nuclear facility in the United States, be mindful of what the consequences of your actions can be at all times.  Am I telling you not to drink?  Hell no.  Be smarter about what you do when you drink.  And if you think I am merely spouting off some high and mighty ideals here, do a search of my posts.  I had no problem owning up to colossally screwing up on this public board.


OK, enough soap box this morning.  Be smart and stay out of trouble.

   I agree with BZ, usefull advice is true and accurate. This site could never be accused of coddling anyone but then that would be dishonest. We can be accused of being "Curmudgeons R Us", one would not expect an apology from a curmugeon. This is an open site so you cannot expect everyone to respond the same, but in Toto the advice here is very helpful and frequently from subject matter experts.

Responded to your pm.

However, for future reference --

Most utilities I've ever dealt with will not take anyone who has a 'pending' drug/alcohol charge. Really and truly they won't take anyone who has any kind of pending charges simply because the outcome of the case obviously hasn't been decided. Speeding tickets obviously don't fall under charges that you have to list or report, unless you were arrested.

In this case he will have to wait until his case is adjudicated. After that as was said before he will more than likely have to see a substance abuse counselor to make sure there aren't any underlying drug/alcohol issues. So even if his charges are reduced he will still have a few hurdles to jump.

I wouldn't risk trying to gain access with a pending charge. It's bad enough to have the charges.. but you don't want a denial of access on top of those charges.

Sorry haven't been around .. this Turkey Point outage has been killing me! First one is over now though :)
