Courts Dismiss Challenges to NY, IL Zero-Emission Credit Programs
In a pair of key wins for the nuclear energy industry, federal district courts in Illinois and New York dismissed lawsuits challenging those states’ zero-emission credit programs for at-risk nuclear power plants. The courts in both cases ruled that states have the authority to incentivize clean energy generation, and that such measures are not preempted by federal authority.
