I am new to this to please entertain these naive questions. There has been much talk throughout the previous threads about legal actions (DUI etc...) dating back to ones 18th birthday. I get this, be honest.
What I have yet to see discussed is if this is applicable for the following sections:
- Section 1-residences - past seven (7) years. Easy
- Section 3 - self-disclosure - In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter.
- Section 4 - Employment - In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter.
- Section 6 - Legal Actions - All the way to age 18...understood.
The problem is with the wording with section 3 and 4. My employer is interpreting this as either "last period of UAA/UA was terminated favorably or since your 18th birthday." I read simply the past FIVE years, period. Which is correct? Is the past 5 years the third option or merely tied to the last UAA. Since I have never had an UAA this would require 20 years worth of records. Is this realistic?

It is possible that they gave you the wrong PHQ to fill out. The only thing that the initial background paperwork should read, per procedure, is "In the past 5 years, or since your 18th birthday whichever period is shorter".
Self disclosure is more geared towards former employers, former FFD failures etc. This isn't really about legal actions which is where you list your criminal history. So in other words if you are 21 then you would just go back to your 18th birthday since it is less than 5 years ago. But let's just say you are 45 you only need to go back 5 years because obviously that period is SHORTER than going back to your 18th birthday. This is for self disclosure only.
If you were an update, meaning that you have had access within the past 3 years, then your paperwork would read "In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter." Since you aren't an update this doesn't really apply.
Employment history is only a 3 year check, according to position but most positions only require a 3 year check. It can become an expanded check, 2 more years (So 5 years check), IF you have had any drug/alcohol related issues within the past 5 years. Whether it be a DUI, open container, minor in possession etc etc etc. Doesn't matter if you were charged or not or got it dropped or not still have to do it. Now if you are an initial and it was a DUI from 1975 and you are applying today, you still only do the 3 year check. It's anything within the past 5 years.
------- This doesn't mean they can't make you have an interview or do an expanded scope if the utility requests it. ---------------- So in other words if you have 10 charges just outside the 5 years they may ask you to have the interview and do the expanded scope anyways.
As for legal actions yes go to your 18th birthday no matter what.
