Initial PHQ for UAA clearance

Hello everyone,

I am new to this to please entertain these naive questions.  There has been much talk throughout the previous threads about legal actions  (DUI etc...) dating back to ones 18th birthday.  I get this, be honest.

What I have yet to see discussed is if this is applicable for the following sections: 

• Section 1-residences - past seven (7) years.  Easy
• Section 3 - self-disclosure - In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter.
• Section 4 - Employment - In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter.
• Section 6 - Legal Actions - All the way to age 18...understood.
  

The problem is with the wording with section 3 and 4.  My employer is interpreting this as either "last period of UAA/UA was terminated favorably or since your 18th birthday."  I read simply the past FIVE years, period.  Which is correct?  Is the past 5 years the third option or merely tied to the last UAA.  Since I have never had an UAA this would require 20 years worth of records.  Is this realistic?

I am sure you will get the more official word from our resident (well, frequent visitor) background investigator, but the options are three:

1. For the last 5 years
2. Since your 18th Birthday
3. Since your last Unescorted Access

Pick the shortest period of time.

For instance:
If you are 25 and have never had Unescorted Access, 5 years. (25-18 = 7, 5< 7)

If you are 22, the answer would be 'Since your 18th birthday' (22-18,= 4, 4< 5)

If you had Unescorted Access last year, it trumps all of the other examples since 1 year is less than 4 or 5... you have to account for all time since you last held the clearance (i.e. handed in your badge when leaving the plant.)

Sometimes (in some plants) you will be asked to do another clearance package for the last 5 years no matter how long ago you were last carrying a badge. I left one plant on a Thursday afternoon and reported to another plant owned by the same utility on the following Monday and had to do the whole 5 years paperwork. I also once left a plant (the same one in the previous example) on a Saturday and reported to (the same second plant in the previous example) on a Monday (technically a one day separation) and had to do the whole background check, retake the MMPI, have a Psychiatrist interview, and an FBI interview before I could get access. But that was after an act of suspected sabotage had been performed on the first plant while I was still there.

Thank you for your response.  Despite this, I am still being instructed to provide the past 20 years work history and explain any gaps.

Is anyone familiar with such stringent requirements?

 While we wait on the "official" response, Cornfed,  I have to say my recommended attitude would be
  "Whatever The Employer Wants."  They're paying you, so they're right.
This won't be the first or last time you'll scratch your head and say, "That doesn't quite make sense", if you stay in this business.

I don't think you have any option from what I have read.  If you have never had a UAA then its back to 18 period.  I have had UAA's for many years at one utility but its never been terminated so every 5 years during reinvestigation, I have to go all the way back to 18 also.  And for me thats a ways 

I also kind of think that its a trick to try and catch you saying something different than you previously said

It is possible that they gave you the wrong PHQ to fill out. The only thing that the initial background paperwork should read, per procedure, is "In the past 5 years, or since your 18th birthday whichever period is shorter".

Self disclosure is more geared towards former employers, former FFD failures etc. This isn't really about legal actions which is where you list your criminal history. So in other words if you are 21 then you would just go back to your 18th birthday since it is less than 5 years ago. But let's just say you are 45 you only need to go back 5 years because obviously that period is SHORTER than going back to your 18th birthday. This is for self disclosure only.


If you were an update, meaning that you have had access within the past 3 years, then your paperwork would read "In the past 5 years, since your last period of UAA/UA was terminated favorably or since your 18th birthday, whichever period is shorter."      Since you aren't an update this doesn't really apply.


Employment history is only a 3 year check, according to position but most positions only require a 3 year check. It can become an expanded check, 2 more years (So 5 years check), IF you have had any drug/alcohol related issues within the past 5 years. Whether it be a DUI, open container, minor in possession etc etc etc. Doesn't matter if you were charged or not or got it dropped or not still have to do it. Now if you are an initial and it was a DUI from 1975 and you are applying today, you still only do the 3 year check. It's anything within the past 5 years. ------- This doesn't mean they can't make you have an interview or do an expanded scope if the utility requests it. ---------------- So in other words if you have 10 charges just outside the 5 years they may ask you to have the interview and do the expanded scope anyways.


As for legal actions yes go to your 18th birthday no matter what.
