HELP!!!!!!

Greetings,

I am a road tech and not new to nuke but I made a new guy mistake.  I have been charged with possession of Spice and paraphernalia. Spice is a synthetic form of marijuana. I purchased it in a store in my city not knowing it is illegal. Its was the dumbest mistake of my life.  This is my first time ever getting charged with anything other than a speeding ticket, I have a completely clean record.  It will be dismissed, but it will take 6 months to get it permanetley taken out of public record.  How is this going to affect my UA?  I am less than 365 since my last UA and the fall season is fast approaching.  Should I sit out the fall season to give it more time?

It is legal but its up to the police officers discretion. I told him it is legal. Btw I have noticed some of your comments on here and 90% of them are negative. That does not make sense.... If it was legal then you would not need a police officers discretion.... Hence it was illegal and you have to man up and deal with it.  The arrest would have to be reported even if charges are dropped.  Is it explainable? Probably, but will depend on the utility if they choose to grant unescorted access.

Bull s**t. A cop does not have the authority to decide if something is illegal or not. It either is, or it isn't, and that is decided by the legislature of the state you're in, or Congress.

Incorrect an officer cannot decide if it is legal or not. As for your other concern, you're posting on a forum populated by individuals who not take synthetic drugs and try to pretend they make no difference. No one here is going to coddle you or give you a shoulder to cry on. That's your mother's job.

Lol I simply wanted to know how this would affect my status that is it. I didn't need the peanut gallery to give there opinion unless it gave me the answer I was looking for.

You don't get to knock on others for negativity and then respond like a child! You were clearly doing things you should know better than to be doing and throwing the dice with your own career. Why should others line up to help you undo the damage if your judgement is this terrible? I hope they don't let you on a site again.

          The reason police more than likely detained you is because, SPICE is commonly identified as a marijuana substitution.  I believe you when you state "that you did not know it was illegal" but, let's face it, we both know why you bought it.....    

To answer your question:
          I would wait the 6 months to let the charge fall off your record. Just to be safe.  You dont want a night of fun ruin your career.

Sorry pretty busy as of late but most utilities aren't going to give access to someone who has a charge that is pending. I would say there are a few that they will let slide but this one I highly doubt any utility will let slide. Spice already has a bad rap and it doesn't show up on a DOT drug test that utilities are mandated to give. How would they know if you are 'high' on the job? I won't say I've ever dealt with anyone who has had this charge but just from hearing others talk about it in the past and knowing how utilities work, then they will basically treat this just like it was a controlled substance (which it now is in some states).

I would wait to try and gain access. Even if the charge does get dismissed, you will have to jump through all the extra hurdles that anyone else would with a similar charge of Marijuana possession etc. More than likely will have to do an extended work history, substance abuse evaluation and speak with the psych/mro.

Don't hold me to it but look at it like this..

If you were Access Supervisor what does the utility or he/she have to gain by hiring someone who has used a 'drug' that doesn't show up on drug tests? There are so many variables of things that could go wrong.. OSHA Recordables, tripping units, loss time accidents.. so many things. Drugs/alcohol -- whether illegal or not in this case -- are pretty much the worst charges that you can have at a nuke plant, which you should know if you've worked nuclear before.

Good luck, but my suggestion is to take your trade or skills elsewhere for a while and let the courts work it out.
