NukeWorker hosts material uploaded by its members, including gallery photos, forum posts, profiles, and job and resume listings. We respect the rights of copyright owners and respond promptly to valid notices of claimed infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Filing a Notice of Infringement

If you believe material on NukeWorker infringes a copyright you own or are authorized to enforce, send our agent a written notice that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim is infringed.
  3. Identification of the material you claim is infringing, with enough information for us to locate it, preferably the exact URL of each page or image.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act on the owner's behalf.

When we receive a notice that meets these requirements, we remove or disable access to the identified material expeditiously and make a reasonable effort to notify the member who posted it. A notice that is missing required elements may not be acted upon.

Counter-Notification

If material you posted was removed and you believe it was removed by mistake or misidentification, you may send our agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for your address (or, if you are outside the United States, any judicial district in which NukeWorker may be found), and that you will accept service of process from the person who filed the original notice or that person's agent.

After receiving a valid counter-notice, we forward it to the original complainant. Unless the complainant notifies us that they have filed a court action seeking to restrain the activity, we may restore the material in not less than 10 and not more than 14 business days.

Repeat Infringers

It is our policy, in appropriate circumstances, to disable or terminate the accounts of members who repeatedly infringe the copyrights of others.

Your Responsibility When You Upload

Only upload photos and other material that you created yourself or have permission to share. News-agency and wire-service photos (for example AP, Reuters, or Getty Images) are licensed content and may not be posted without a license. Uploads that infringe may be removed without notice. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether material infringes your rights, consider consulting an attorney before sending a notice.
